小作坊食品安全犯罪治理:现状、原因与对策 被引量:3

Governance of Food Safety Crime in Small Workshops: Current Situation, Causes and Countermeasures

摘要 随着"地摊经济"的火爆,食品小作坊作为食品安全犯罪的风险源、频发地、重灾区,亟需得到有效治理。通过对无讼案例网218份判决书的法律实证分析,发现小作坊食品安全犯罪呈现出地域特征明显、经营方式集中、犯罪手段多样等现实问题,使得此类食品安全犯罪具有更多的特殊性和复杂性。基于此,在系统分析其犯罪原因的基础上,从经营主体、法律规制、监管机制、犯罪侦查、社会共治五方面对中国小作坊食品安全犯罪治理提出对策建议。 With the popularity of "stall economy", as the risk source, frequent place and hardest-hit area of food safety crime, small food workshops are in urgent need of effective management. Through the legal empirical analysis of 218 judgments of Wusong, it can be found that the food safety crime in small workshops presents some practical problems, such as obvious regional characteristics, centralized mode of operation, various means of crime and so on. It makes this kind of food safety crime have more particularity and complexity. Therefore, on the basis of systematic analysis of the causes of the crime, it is necessary to put forward countermeasures and suggestions for the food safety crime of small workshops in China from the following five aspects including business subject, legal regulation, supervision mechanism, criminal investigation and social co-governance.
