摘要
随着互联网步入移动互联阶段,新经济进一步探索并确立了通过扩展服务架构来动态追踪用户和资源、加强数据分析的生产方式,"破坏式创新"和分享经济在继续推进,围绕数据资源和用户注意力的侵权和不正当竞争越来越多地出现在互联网企业之间,这可被视为"非法兴起"的延续。本文以这一过程中数据财产权的形成为例,讨论其三个主要特征:首先,新经济的兴起要求资源保持流动和低成本非法获取,动态地积累更多用户活动和数据,但同时希望它们在自己的不断扩展的架构内流动,而非跨平台流动,从而通过架构的微观机制不断监控追踪;其次,平台企业通过技术和商业模式不断将产品转化为服务,进行中心化调控;最后,数据资源不仅需要流动,更需要积累,以便形成数据资源池和规模效应。本文还对数字经济的未来生产进行展望,思考采取何种生产机制能够进一步调动闲置资源推动生产。
As the Internet has stepped into the mobile era,the new economy has further explored and established a kind of mode of production to expand architecture of service,trace users and resources dynamically,as well as enhance data analysis.More disruptive creation and sharing economy continue to develop.More and more infringements and unfair competition behaviors concerning data resources and users’attention occurred among internet companies.This process could be regarded as continuation of the previous history of the illegal rise of the Internet.This paper takes the formation of data property rights as an example to discuss its three key features:Firstly,the rise of new economy requires free flow of and low-cost illegal access to the resources,accumulating users’activities and data dynamically while expecting them to flow within the extended range of platform rather than cross platform,so as to monitor and trace through micro mechanism of the architecture.Secondly,platforms continue to transform goods to services via technology and business model and moderate in a centralized way.Thirdly,data needs to accumulate and flow to form some kind of data pool and mass effect.This paper will look into the future of digital production,thinking of how to allocate more idle resources by way of certain productive mechanism.
