摘要
为社会公众提供全面、优质的公共法律服务是法治社会建设的重要目标任务,实现该目标任务有必要运用政府向社会购买的方式。目前政府购买公共法律服务存在一些制度机制欠缺,尚未妥善调整购买活动中政府、承接方以及社会公众之间的多重法律关系,也不能充分满足法治社会建设的新需求。完善政府购买公共法律服务,应当从拓展购买范围、强化政府诚信、规范行政优益权行使、健全承接方社会责任和纳入行政公益诉讼范围等方面展开。
Providing comprehensive and high-quality public legal services to the public is an important goal and task for the construction of a society with rule of law.To achieve this goal and task,it is necessary to depend on the government to purchase from the society.At present,there is still lack of institutional mechanisms for the government to purchase public legal services.The multiple legal relationships between the government,the undertaking party and the public in the purchase activities have not been properly adjusted,nor can it fully meet the new needs of the construction of a legal society.To improve the government’s purchase of public legal services,it should start from expanding the scope of purchase,strengthening government integrity,regulating the exercise of administrative benefits,improving the social responsibility of the undertaking party and including the scope of administrative public interest litigation.
