摘要
不可抗力是指不能预见、不能避免并且不能克服的客观情况。其来源既有地震、海啸等自然现象,也有军事行动、重大公共卫生事件等社会现象。而不可抗力的发生往往对社会具有一定的危害性,大多数国家的法律也将其作为一项免责条款。这就意味着不可抗力的发生会给企业带来额外的风险,对企业的经营造成更大的挑战。对物流企业而言更是如此。因此,分析不可抗力对物流企业的影响并提出相应的策略将有很重要的现实意义。文中将以重大公共卫生事件为例,探讨不可抗力对物流企业的影响,物流企业做好应对不可抗力准备的积极意义,并根据实际情况提出物流企业应对重大公共卫生事件的策略。
Force Majeure refers to the objective situation that can not be foreseen,avoided and overcome.Its sources include not only natural phenomena such as earthquakes and tsunamis,but also social phenomena such as military operations and major public health events.The occurrence of force majeure is often harmful to the society,and most countries’laws also regard it as an exemption clause.This means that the occurrence of force majeure will bring extra risks to enterprises and cause greater challenges to the operation of enterprises.This is especially true for logistics enterprises.Therefore,it is of great practical significance to analyze the influence of force majeure on logistics enterprises and put forward corresponding strategies.This paper will take major public health events as an example to explore the impact of force majeureon logistics enterprises,the positive significance of logistics enterprises to prepare for force majeure,and put forward the strategies for logistics enterprises to deal with major public health events according to the actual situation.
