摘要
数字经济时代下,大规模数据跨境流动已成为促进国际贸易快速发展的新引擎,但同时也对公民隐私、企业商业机密及国家安全造成极大威胁。如何在鼓励数据跨境自由流动的主基调下进行必要监管,最大化保护本国利益与安全,是各国政府管理部门及隐私保护机构需要高度关注的问题。欧盟和美国在数据跨境监管方面起步较早,已形成较为成熟的监管体系。我国在实施跨境数据流动监管过程中,应结合自身特色,积极借鉴欧美经验做法,确立分级分类监管体系,打造数据联合监管同盟,增加统一机构评估情形及明确监管机构责任,以形成兼具中国特色与智慧的跨境数据监管体系。
In the era of digital economy, large-scale cross-border data flow has become a new driving force for the rapid development of international trade, but at the same time it will also pose a great threat to citizens’ privacy, corporate business secrets, and national security. How to conduct necessary supervision under the main theme of encouraging the free flow of data across borders to maximize the protection of national interests and security is an issue that government management departments and privacy protection agencies of various countries need to pay close attention to.The European Union and the United States started early in cross-border data supervision and have formed a relatively mature supervision system.In the process of implementing the supervision of cross-border data flow, China should combine its own characteristics, actively absorb the experience of Europe and the United States, and make improvements from the establishment of hierarchical and classified supervision system, the creation of data joint supervision alliance, the increase of unified institutional evaluation, and the clarification of regulatory agency responsibilities, so as to form a cross-border data supervision system with Chinese characteristics and wisdom.
