摘要
从公众关注的热点个案审判实践入手,总结热点个案的办理成功经验和办理失败教训,分析公众代入热点案件的角色情结及对热点案件裁判结果的预期与反应,指出审理热点个案应该跳出个案思维及热点案件裁判吸纳公众诉求的必要性,确保裁判结果为公众广泛接受。同时,要在审理中利用案件受关注的特点借力发力,将公众零散的、朴素的公共理性上升为个案规则,提炼出鲜明的价值导向,继而引导更多公众遵从个案裁判确定的行为准则,在众声喧哗中弘扬主流价值观,以公正裁判树立行为规则,引领社会新风尚。
This paper starts with the trial practice of hot cases concerned by the public,summing up the success and failure of hot case handling and analyzing the situation public roles as the litigants and anticipation or reaction to the results of the hot cases.It points out that the mindset of analyzing one case and necessity of welcoming public appeal by hot cases should not be concerned,otherwise it supports the judgement being acceptive by the overall public.Simultaneously,the public concern in the case can be taken as the rule of case or the value concept by guiding the sporadic and simple public reason.This can be conduct codes followed by more people to propaganda the mainstream value orientation in the public and foster the new social conduct by the rule established by the fair judgement.
