摘要
法无禁止即自由。医疗服务法治化建设滞后是医患关系矛盾激化的重要原因。推进医疗服务法治化建设,让医患纠纷有法可依、有法可循有助于解决医患矛盾。从医患关系的现状和成因入手,分析医患关系模式变化和医患关系的法律适用现状。最后,从五个不同的立法角度提出构建和谐医患关系的法律路径,以期为推进医疗服务法治化进程提供参考。
Freedom means no prohibition by law.The lag of the legal construction of medical services is an important reason for the intensification of the contradiction between doctors and patients.Promoting the legalization of medical services and letting disputes between doctors and patients be governed by law will help to solve the contradiction between doctors and patients.This paper started with the current situation and causes of doctor-patient relationship,then analysed the changes of the doctor-patient relationship model and the current legal application of doctor-patient relationship.Finally,the article put forward the legal path of building a harmonious doctor-patient relationship from five different legislative perspectives,in order to provide reference for promoting the process of legalization of medical services.
