摘要
随着海南自贸港建设的稳步推进,邮轮业市场规模也随之扩增,这将难以避免多元利益主体间的矛盾争端。在海南自贸港邮轮旅游纠纷非诉化解体系中,投诉机制未能与时俱进,和解机制的优势未充分发挥,调解机制未与时俱新,仲裁机制未建立有效对接,因此既不能供给解纷实践,也不能满足海南法治化营商环境的需求。应当以“把非诉讼纠纷解决机制挺在前面”的顶层设计为理念,坚持效率优先、尊重程序选择权等原则,从革新邮轮纠纷投诉机制、畅通和解通道、再造调解体系、优化仲裁机制等层面,构建分层递进式、相互协调衔接的邮轮纠纷化解新模式。
With the steady progress of Hainan free trade port construction,the scale of cruise industry market is also expanding,which will be difficult to avoid contradictions and disputes among multiple stakeholders.In the non litigation settlement system of cruise tourism disputes in Hainan free trade port,the complaint mechanism fails to keep pace with the times,the advantages of the settlement mechanism are not fully utilized,the mediation mechanism is not up-to-date,and the arbitration mechanism is not effectively connected.Therefore,it can neither provide dispute resolution practice nor meet the needs of Hainan’s legalized business environment.Taking the top-level design of“putting the non litigation dispute settlement mechanism in front”as the concept,adhering to the principles of efficiency priority and respect for the right of procedure selection,we can build a new hierarchical progressive and mutually coordinated and connected cruise dispute resolution mode from the aspects of innovating cruise dispute complaint mechanism,smoothing settlement channel,reconstructing mediation system,optimizing arbitration system,etc.
