摘要
以制度失信惩戒为内涵的涉医违法失信惩戒具有加强违法行为防控、覆盖各个领域、平衡惩戒必要性和适度性等特征,能够起到维护公共利益、凸显行业保障、修复医患关系等作用。但从社会治理的角度审视,《备忘录》仍存在缺少立法依据,程序不够健全和规范,没有完全遵守比例原则等法治意义上的缺憾,难以实现善治目的。建议健全法律依据,将涉医违法失信惩戒纳入行政处罚之中;完善配套法律规范;健全惩戒的启动、监督、撤销程序;设立救济途径。
The punishment of illegal and breach of trust with the connotation of systematic breach of trust has the characteristics of strengthening the prevention and control of illegal acts,covering overall fields,balancing the necessity and moderation of punishment,and can play the role of safeguarding the public interest,highlighting industry protection and repairing the doctor-patient relationship.However,from the perspective of social governance,the Memorandum still has some legal problems,such as lack of legislative basis,imperfect and nonstandard procedure,which is difficult to achieve the goal of good governance.It is suggested to improve the legal basis,bring the punishment of illegal breach of trust in medical treatment into administrative punishment,perfect the supporting legal norms,improve the procedures of initiating,supervising and withdrawing punishment,and establish relief channels.
