摘要
与传统监察手段相比,大数据让民生监察主体、方法、时间、空间、工具等方面都发生了巨大的变化,让民生监察的透明度、参与度、针对性和动态性更好。本文以T县民生监察大数据平台为例,系统剖析大数据驱动民生监察的独特价值、运行逻辑、现实困境及未来图景。分析发现,民生监察平台中的大数据对权力的监察更加精准,可以实现监察主体的多元化、监察过程的透明化。究其原因,民生监察大数据平台的运行有其独特的数据逻辑、“权力+权利”逻辑和技术逻辑,但也面临数据崇拜、数据伦理、数据壁垒等困境,会带来数字监察的形式主义、个人信息的二次使用和部门监管的纵强横弱,建议从实现人机契合、明确职责范围、建立基于区块链技术的大数据监察平台等角度出发,解决监察中的数据崇拜、隐私保护、数据壁垒等问题。
Compared with traditional supervising methods,big data has brought about great changes in the subjects,methods,time,space and tools of people’s livelihood supervising,making the transparency,participation,pertinence and dynamics of people’s livelihood supervising better.This paper takes the People’s livelihood supervising big data platform in T County as an example to systematically analyze the unique value,operation logic,realistic dilemma and future prospect of big-data-driven livelihood supervising.It is found that the big data in the people’s livelihood supervising platform is more accurate,which can realize the diversification of supervising subjects and the transparency of supervising process.The reason is that the operation of the livelihood supervising big data platform has its own unique data logic——“power+right”logic and technical logic,but it also faces difficulties such as data worship,data ethics and data barriers,which bring the formalism of digital supervision,the secondary use of personal information,and the vertical strength and horizontal weakness of department supervision.It suggests that we should realize the man-machine cooperation,clarify the scope of responsibilities and establish a foundation from the perspective of big data supervising platform of block chain technology,to solve the problems of data worship,privacy protection and data barrier in supervision.
