摘要
伴随新冠肺炎疫情的爆发及蔓延,各类涉疫情刑事案件高发。为做好疫情防控工作,公安司法机关多措并举严厉打击各类涉疫情犯罪,迅速遏制住了涉疫情犯罪的高发势头。从B市的情况来看,畅通涉疫情案件线索双向移送、联合执法办案等措施有效地打击了涉疫情犯罪,但是还存在着涉疫情刑事案件侦查取证困难,涉案物品的检验检测难,部分案件的法律定性难、移送程序复杂等问题。为此需拓展渠道依法、科学收集调取证据;推动与行政执法、检验检测机构合作破解检测难题;细化法律细则严格规范涉疫情案件的定性;简化案件衔接严密打击涉疫情犯罪链条。
At the beginning of the new year,the new crown pneumonia epidemic broke out suddenly and spread globally.Accompanying the epidemic is the high incidence of various types of criminal cases involving epidemic prevention and control.In order to do a good job in the prevention and control of the epidemic,the public security and judicial organs have taken multiple measures to crack down on all kinds of epidemic-related crimes and quickly curbed the high incidence of epidemic-related crimes.Judging from the situation in City B,the two-way transfer of clues to epidemic-related cases and joint law enforcement has effectively cracked down on epidemic-related crimes.However,there are still problems such as difficulties in investigating and obtaining evidence in criminal cases involving epidemics,inspection and testing of items involved,difficulty in legal identification of some cases,and complicated transfer procedures.To this end,it is necessary to expand channels to collect and retrieve evidence in accordance with the law and scientifically;promote cooperation with administrative law enforcement and inspection and testing agencies to solve detection problems;refine legal rules to strictly regulate the identification of epidemic-related cases;simplify the connection of cases and strictly combat the chain of epidemic-related crimes.
