摘要
在突发的紧急事件面前,需要调动全社会的资源共同抗击灾情,而应急征用是很高效的行政手段。但征用是直接对私主体权利的侵害,容易引发社会对"假公共利益之名,侵害私人权利"的担忧,所以应急征用需要严格的程序和事后的补偿来消除这种担忧。目前我国的应急征用体系存在效力和逻辑上的矛盾,缺乏一部有较高操作性的法律统领,而在具体的内容方面对征用主体、征用程序、补偿义务主体、补偿范围、补偿标准和补偿方式等缺乏规定。在此背景下,有必要修订一部专门的《征收征用法》,对应急征用制度进行完善的规定。
In the face of emergency,we need to mobilize the resources of the whole society to fight against the disaster,and emergency requisition is a very efficient administrative means.However,expropriation is a direct infringement on the rights of private subjects,which is easy to cause social concern about"infringement of private rights in the name of public interest".Therefore,emergency requisition needs strict procedures and ex post compensation to eliminate this concern.However,there are contradictions between the effectiveness and logic of the emergency requisition system in China,and there is a lack of a highly operational legal command,and the specific content of the expropriation subject,requisition procedure,compensation obligation subject,compensation scope,compensation standard and compensation method are lack of provisions.Therefore,in this context,it is necessary to revise a special"expropriation and requisition law"to improve the emergency requisition system.
