专利侵权中技术特征的界定宜采用“普通含义解释”原则,依据权利要求的记载、结合说明书及其附图和参考专利审查档案。专利授权中技术特征的界定宜采用“最宽合理解释”原则,权利要求中的用语依其日常和习惯含义、在说明书中的界定或描述。专利确权中技术特征的界定宜审慎采用“最宽合理解释”原则。
The definition of technical feature in patent infringement should adopt the principle of"ordinary meaning interpretation",which is based on the claim record,combined with the specification and attached drawing,and referred to the patent examination file.The definition of technical feature in patent authorization should adopt the principle of"broadest reasonable interpretation",in which the claim term should be identified with its ordinary and customary meaning,and defined or described in the specification.The definition of technical feature in patent confirmation should carefully adopt the principle of"broadest reasonable interpretation".
