摘要
宅基地“三权”分置的实质是细化宅基地产权束为所有权、资格权和使用权,并通过相应的制度安排,使三项权利在不同主体之间进行合理配置,以实现权利结构平衡、功能平衡、价值平衡和收益平衡。作为一种制度创新,宅基地“三权”分置可能面临集体所有虚化、利益分配失衡、乡村治理失效及宏观调控失灵等风险。防范宅基地“三权”分置可能风险应以明晰权属为基础,不断夯实“三权”分置的配套制度;以财政投入为工具,合理分担宅基地“三权”分置的创新成本;以中间扩散为路径,持续优化宅基地“三权”分置的供给方式。
The essence of the“three rights division”of homestead is to refine the property right of homestead into ownership,qualification right and use right,and to rationally allocate the three rights among different subjects through corresponding institutional arrangements,so as to achieve the balance of right structure,function,value and income.As a kind of institutional innovation,the“three rights division”of homestead may face the risks of collective ownership,imbalance of benefit distribution,failure of rural governance and failure of macro-control.To guard against the possible risks of the“three rights division”of the homestead,we should constantly consolidate the supporting system of the“three rights division”on the basis of detailed ownership,rationally share the innovative cost of the“three rights division”of the homestead with financial input as a tool,and continuously optimize the supply mode of the“three rights division”of the homestead through the middle diffusion.
