摘要
追溯城管执法之"城",从执法目的上看,城管与执法对象之间存在着根本的利益冲突。透视城管执法之"管",它以控制性理念主导下的"管制"为基础,以服务型政府建设中的"服务"、城管提升自身执法水平所需的"艺术"为旨归。叩问城管执法之"法",它存在"法不容情"的现实困惑、"法中有情"的情理冲突、"法不健全"的短板制约等困境。从"城""管""法"三个向度判读,有利于改善城管执法的理念,创新城管执法的方式,解决城管执法的难题。
Tracing back to the"city"of urban management law enforcement,there is a fundamental conflict of interest between urban management and the object of law enforcement.The"management"of urban management law enforcement is based on the"control"guided by the concept of control,aimed at the"service"in the construction of a service-oriented government and the"art"needed by urban management to improve its law enforcement level.Inquiring about the"law"of urban management law enforcement,it has the realistic puzzlement of"intolerable law",the rational conflict of"sentient law"and the short-board restriction of"defective law".The interpretation of these three dimensions is significant for improving the concept of urban management law enforcement,innovating the way of urban management law enforcement,and solving the problems of urban management law enforcement.
