摘要
著作权激励理论的“经济人”假设存在一定缺陷,导致著作权激励的限度模糊不清,进而影响著作权制度的发展,使其一直呈现扩张趋势。行为经济学对“经济人”假设的批判可为著作权激励边界的划定提供指引,进而为著作权法的完善给予有益的理论支持。由于作者和投资者皆是有限自利、有限理性及有限意志力的,超出这一限度的著作权激励均属于无效激励。因此,应当对著作权法的保护范围进行适当限制,包括限制对非经济动机类作品的保护,引入可预见性规则,缩短著作权保护期等。
The“economic man”hypothesis of Copyright Incentives Theory has some defects,which make the boundary of copyright incentives obscure and the scope of copyright protection expanding.The criticism of the“economic man”hypothesis of behavioral economics can provide guidance for the delineation of the copyright incentives boundary,and give useful theoretical support for the perfection of the copyright system.Since the authors and the investors are limited self-interest,limited rationality and limited willpower,the copyright incentives beyond this are invalid and should not be protected.So the scope of protection of the copyright should be appropriately restricted,including restrictions of the protection of non-economic motivational works,the introduction of predictability rules,and the reduction of copyright protection periods.
