摘要
地方性法规清理与行政法规、规章清理在内容上存在重合部分,两者都包含清理实施主体在开展清理工作时应当遵循的步骤、阶段和过程。与之不同的是,地方性法规清理还包括在每一个阶段所要完成的基本工作和任务以及所需采用的工作方法、机制、组织和保障等。地方性法规清理具有审查、处理、协调的功能,但是现行的地方性法规清理模式存在清理标准不明的缺陷,在一定程度上影响了清理功能的发挥,导致不同省市的清理标准不一。需要进一步确定清理主体,坚持“谁指定、谁清理”的原则;明确应遵循的清理标准方式,如合法性标准、合理性标准、协调性标准等。
There are overlapping parts in the content of local laws and administrative laws and regulations,both of which contain the steps,stages and processes that should be followed by the main body of the cleaning implementation when carrying out the cleaning work.The difference is that the cleanup of local laws and regulations also includes the basic work and tasks to be completed at each stage,as well as the working methods,mechanisms,organization and guarantees to be adopted.Local laws and regulations have the functions of review,processing and coordination,but the current model of local laws and regulations has the defects of unclear cleaning standards,which affects the performance of the cleaning function to a certain extent,resulting in different cleaning standards in different provinces and cities.It is necessary to further determine the cleanup subject,insist on the principle of“whoever designates,who cleans up”;clarify the cleanup standard methods to be followed,such as legality standards,rationality standards,coordination standards,etc.
