摘要
当前,我国扫黑除恶专项斗争取得了丰硕的战绩,根据扫黑除恶专项斗争所破获案件的情况来看,农村黑恶势力违法犯罪主要表现出"擦边球"软暴力事件频发,黑恶势力垄断农村行业经济,操控农村流动赌博,黑恶势力内部关系复杂、保护伞强大等新的特征。在农村自治弱化的背景下,农村居民生活方式改变,农村地区贫富差距拉大、社会保障不健全,农村内部充斥着残余的传统思想和犯罪亚文化,农村自治组织与黑恶势力相互纠缠,导致农村地区黑恶势力违法犯罪泛滥。在自治理论视角下,需要加强农村自治组织的建设、加强基层政府对农村自治组织的领导和监督,加强农村自治、完善农村警务站建设,发挥自治组织的集体经济管理职能、深入开展农村地区的法律宣传教育工作,以提高国家对农村黑恶势力违法犯罪的预防和整治能力。
Currently, China has made great success in fighting against the triad gangs. Based on solved cases in this fight, new characteristics can be seen in the rural triad gangs crime, such as high frequency of"soft violence"which take advantage of the legal loopholes,the monopolization in economic regulations, manipulating the rural floating gamble market, the complexity in its inner relationship, the powerful protection from the government stuff, etc. In the background of weakening rural autonomy, changes in rural population’s living habits, the wider gap between the poor and the rich, the unsound social welfare system, the remaining of traditional thoughts and the criminal subculture, as well as the interaction between the rural autonomous organization and the triad gangs all contributed to the overflowing of triad gangs crime. Based on the self-government theory, we need to strengthen the construction of the rural autonomous organization, improving local government’s leadership and supervision of the rural autonomous organization, reinforce the autonomy of rural areas, develop the construction of rural police station, let the autonomous organization play its functional roles in collective economy and strengthen the publicity and education of law in the rural areas, so that our country can better improve the prevention and regulation of the rural triad gangs crime.
