摘要
检察官司法责任追究制度亟须进一步完善,为此有必要对司法责任的性质和内涵、司法责任的追究主体等基本问题统一认识。所谓司法责任,是检察人员在司法办案过程中,由于违反检察职责导致办案错误发生,应当予以追究的办案过错责任。对于检察官司法责任的追究,应当由人民检察院进行调查,经检察官惩戒委员会审议后,人民检察院依法作出处理决定。这与监察法规定的国家监察全覆盖并不矛盾,也符合中央司改政策导向和司法权力运行规律。
The judicial accountability system concerning prosecutors needs to be further improved. Therefore,it is necessary to have a unified understanding of the nature and connotations of judicial accountability,the subjects of judicial accountability and other key issues. The judicial accountability refers to the responsibility of the procurators for handling the cases wrongly due to their violation of the procuratorial duty in the judicial procedures. The investigation of the judicial accountability of the prosecutor shall be conducted by the People’s Procuratorate which shall make a judicial decision according to law after the deliberation of the punishment committee of the prosecutors. This is not only in line with the full coverage of the national supervision stipulated by the supervision law,but also in line with the judicial reform policy and the law of judicial operation stipulated by the central government.
