摘要
通过对古今中外相关司法实践经验的考察可以发现,权威与共识是影响判例制度形成、发展、演化的两大主要因素。权威因素主要通过权力运用与制度构建发挥作用,共识因素则依靠市场调节以及自发秩序发挥作用,两者相互影响并对判例制度产生具有阶段性差异的作用。结合我国案例指导制度的发展现状,应当有针对性地设计短期、中期和长期改革目标及路径:短期目标是通过强化案例指导制度的权威来增强该制度的稳定性;中期目标是通过市场机制与自发秩序来夯实案例指导制度的共识基础;长期目标则主要致力于实现案例指导制度向具有中国特色的实质性判例制度转型。
Through the investigation of relevant judicial practice at all times and in all over the world,we can find that authority and consensus are two main factors that affect the formation,development and evolution of case law system.Authoritative factors play a role mainly through the use of power and institutional construction,while consensus factors rely on market regulation and spontaneous order.They interact and have a common effect with stage differences on case law system.Combined with the current situation of case guidance system in China,we should design the short-term,medium-term and long-term reform objectives and paths.The short-term goal should enhance the stability of case guidance system by strengthening the authority of case guidance system;the medium-term goal needs to consolidate the consensus foundation of case guidance system through market mechanism and spontaneous order;the long-term goal is to realize the transformation of case guidance system to substantive case law system with Chinese characteristics.
