摘要
非编人员是高等院校人力资源的重要组成部分,保障了高等院校各项工作正常运转,在学院的行政管理、教学辅助及后勤服务等各个环节发挥着重要的作用。近年来,高校招生规模的不断壮大,对各方面的人员需求日益增加,在编人员因编制总量控制已不能满足需要,只能聘用非编人员来满足各方面的工作需要。但是随着非编人员数量的不断增加,在管理中给各高校带来了诸多问题。特别是《劳动合同法》和《社会保险法》的颁布实施,明确了用工单位应承担的法律责任。北京作为首都,在各项法律法规的实施力度与规范性上都走在全国的前列,在非编人员的管理上使北京市高校面临了很大的风险。怎样规避非编制人员日益复杂的用工矛盾,各高校应研究相关对策,有效控制非编人员数量、依法规范用工、预防劳动争议,减少不良社会影响,构建规范用工新机制。
Non-editorial staff is an important part of human resources in colleges and universities,which ensures the normal operation of all kinds of work in colleges and universities,and plays an important role in the administrative management,teaching assistance and logistics services of colleges and universities.In recent years,with the continuous expansion of the scale of college enrollment,the demand for personnel in all aspects is increasing day by day.Due to the fact that the total staffing control cannot meet the needs any more,non-staff can only be employed to meet the work needs in all aspects.However,with the increasing number of non-staff,many problems have been brought to universities in the management.Especially the"labor contract law"on January 1,2008 and July 1,2011 the promulgation and implementation of the"social insurance law"from the conclusion of labor contracts,performance,remove and endowment insurance,medical insurance,inductrial injury insurance,unemployment insurance,maternity insurance and so on all aspects related to labor relations for a unit to make the law,and clear the accepting entity shall bear legal responsibility,and increased the penalties for employers.As the capital,Beijing takes the lead in the enforcement and standardization of laws and regulations,and the management of non-staff makes universities in Beijing face great risks.How to avoid the increasingly complicated employment contradiction of non-staff,colleges and universities should study relevant countermeasures,effectively control the number of non-staff,regulate employment according to law,prevent labor disputes,reduce adverse social impact,and build a new mechanism to regulate employment.
