摘要
农业大数据的发展为农业产业升级与可持续发展作出了重大贡献,同时也对农业产业竞争中的垄断规制提出挑战,主要表现在农业大数据产业中出现的滥用市场支配地位问题与并购的反垄断审查问题。在应对农业大数据垄断问题时,应当遵循审慎的执法原则,着重对滥用行为与审查评估认定标准进行分析,注重对数据竞争力的考察,根据数据的具体使用情况进行科学合理的论证,在预防农业大数据垄断风险的同时,避免对农业大数据的发展进行过度监管。
The development of agricultural big data has made a significant contribution to the upgrading and sustainable development of the agricultural industry.It also challenges the monopoly regulations in the competition of the agricultural industry,which are mainly manifested in the abuse of market dominance and antimonopoly review of mergers and acquisitions in the agricultural big data industry.When dealing with the monopoly of agricultural big data,we should follow the principle of prudent law enforcement and focus on the analysis of abuse behavior,the standards of examination and evaluation,and the investigation of data competitiveness.At the same time,scientific and reasonable demonstration should be carried out according to the specific use of data in order to prevent the monopoly risk of agricultural big data and avoid excessive supervision of the development of agricultural big data.
