摘要
在政策推动之下,工程总承包在国内得到迅速发展。工程界对工程总承包在不同模式下的风险分担及运用缺乏清晰的认识。工程总承包有多种模式,比较常见的是设计-建造(DB)模式和设计-采购-施工(EPC)模式。文章从FIDIC合同条件为出发点,分析了两种模式的风险分配的不同以及对合同双方权利义务的影响。在此基础上,比较研究了国内工程总承包示范文本的风险分配及模式运用,解析了国内不同工程总承包示范文本的优点和缺点。由于工程总承包经常与融资、运营相结合,形成新的合同模式,因此文章分析了工程总承包的融资、运营模式的实践运用问题。上述工程总承包的不同模式及其在工程实践中的应用,对项目咨询管理、招投标、工程管理及工程结算具有一定的指导意义。
Driven by government policies,general engineering contracting has developed rapidly in China.The engineering industry lacks a clear understanding of the risk sharing and application of different modes of general engineering contracting.There are many modes of general engineering contracting,the more common ones are the design-build(DB)mode and the design-procure-construction(EPC)mode.Starting from the FIDIC contract conditions,this article analyzes the difference in risk distribution between the two modes and the impact on the rights and obligations of both parties to the contract.On this basis,a comparative study on the risk distribution and mode application of the domestic general contracting demonstration texts is further carried out,and the advantages and disadvantages of different domestic general contracting demonstration texts are analyzed.Since general engineering contracting is often combined with financing and operation to form a new contract model,this article analyzes the practical application of financing and operating modes of general engineering contracting.The above-mentioned different modes of general project contracting and their application in engineering practice have certain guiding significance for project consulting management,bidding,project management and project settlement.
