摘要
《刑事司法过程的刑法学建构问题研究》一书是刘远教授长期从事司法刑法学理论的原创性研究成果的集中阐释。司法逻辑的研究方法带来描述方法、系统化方法和刑法学视角的更新,具有基础研究乃至哲学研究的性质。司法逻辑重视刑事司法过程中的情感因素,体现人文关怀,提倡控辩双方平等对抗。刑法学司法逻辑化的方法论是在对传统刑法学理论进行比较广泛、细致的梳理、考辨和反思,并结合中国的司法实践的基础上,建构起的中国自己的刑法哲学话语和刑法学理论体系。
The book"Research on the Construction of Criminal Law in the Process of Criminal Justice"is a concentrated interpretation of Professor Liu Yuan's original research achievements in the theory of judicial criminal law for a long time.The research methods of judicial logic bring about the renewal of descriptive methods,systematic methods and the perspective of criminal law,and have the nature of basic research and even philosophical research.Judicial logic attaches great importance to emotional factors in the process of criminal justice,embodies humanistic care,and advocates equal confrontation between the prosecution and the defense.The methodology of judicial logicalization of criminal jurisprudence is a theoretical system of Chinese criminal jurisprudence philosophy and criminal jurisprudence,which is based on the extensive,careful combing,textual research and reflection of traditional criminal jurisprudence theory and the judicial practice in China.
