摘要
五一广场东汉简牍中包括大量的狱治文书。缀合之后,简2010CWJ1③:201-2+2010 CWJ1③:261-18为“君教”类文书,记载了临湘县阳马亭长种杀官一事,简2010CWJ1①:110为一枚木两行,内容同样事涉该案。两处释文呈现了阳马亭长种杀官一事的前后案情。从文书行政过程来看,两份文书分别属于不同的行政环节。在这一治狱过程中,临湘县贼曹、狱的职能既有相通之处,亦有所差异。东汉时期,县廷诸曹功能逐渐突显,在这一趋势下,贼曹部分分割狱的治狱功能,在县廷诉讼中发挥重要的作用。与此同时,狱逐渐以议罪、收监为主要职能,且只有在临时派遣时参与案件的调查活动。临湘县这一治狱制度的变化是地方诉讼制度变化的一个方面,与汉魏时期地方制度的变革也有密切联系。
A considerable number of judiciary archives dated to Eastern Han on Bamboo or wooden slips were discovered from the May First Square of Hunan Province.The slip No.2010CWJ13:201-2+2010CWJ13:261-18 is one of the Junjiao(君教,lord instruction)documents,which were typically marked with the word Junjiao.This slip records a murder case that was also documented on slip No.2010CWJ11:110.These two records reflect different stage situation of the case.By a close examination of this case,it can be seen that the Zeicao(贼曹,police department)and the Yu(狱,the Jail)shared some common responsibilities and meanwhile hade different roles to play.In the Eastern Han dynasty,the power of the Zeicao were gradually increased while the Yu was limited to guard prisoners with only random investigation tasks.This change was a part of a broader change involved the whole local administration and judiciary systems.
