摘要
为了治理各种环境问题,环境法律法规急切的采取诸如"机动车单双号限行"等各种环保措施,并理所当然地认为为保护环境而制定的各种环境法规都是正当的。环境法以保护环境为己任,但保护环境不能超越正义,环境法应证明自己的正当性,以获得社会各阶层的认可和支持。保护环境与维护民众的合法财产权之间存在一定的冲突,产生了环境正义问题。环境法应接受环境正义的考量,环境正义是环境保护的伦理基础,是环境法正当性的基石。
In order to deal with all kinds of environmental problems,environmental laws and regulations urgently take all kinds of environmental protection measures,such as"single and double vehicle limit",and take it for granted that all kinds of environmental laws and regulations formulated for environmen-tal protection are legitimate.Environmental law to protect the environment as its own responsibility,the protection of the environment can not be above the justice,environmental law should prove its legiti-macy in order to obtain public recognition and support.There is a certain conflict between protecting the environment and maintaining the legitimate property rights of the people,resulting in environmental justice,environmental protection must be taken into consideration of environmental justice,environmental justice is the ethical basis of environmental protection.
