摘要
长期以来,法学教育中法律职业伦理培养的欠缺被公认为是一个严重的问题。法律职业伦理教育不同于一般的专业课程,关注点不在于“知”的传授,而在于“意”的引导,即通过价值引领传递法律人积极向善的正能量。目前,课堂教学环节仍然是涵育法律职业伦理的主要场域,但传统的讲授式教学法无法适应塑造价值观所必须具备的学习者的主体维度。为此,需要改革法律职业伦理的课堂教学。课堂教学应当植根于养成教育的理念,培育学生的伦理问题意识,革新课程的考核方式,以期真正实现立德树人、德法兼修的目标,提高法律人才的培养质量。
The lack of the legal education of the professional ethics has long been recognized as a serious problem.Legal education of the professional ethics is different from general professional courses.The focus is not on the teaching of“knowledge”,but on the guidance of“consciousness”,that is,the positive energy of guiding legal persons to goodness through values.At present,classroom teaching is still the main way of legal education of the professional ethics,but the traditional teaching method cannot adapt to the learner’s subjective dimension that must be displayed to shape the values.Therefore,the author of this article points out the need to reform the classroom teaching of legal education of the professional ethics,which is rooted in the concept of academic education,cultivating students'awareness of ethical issues,reforming the assessment method of the curriculum,and truly realizing the virtues of both people and morals.The goal is to improve the quality of legal personnel training.
