摘要
城市社区居委会高负荷运行是转型期中国基层治理逻辑、基层政府行政制度实践和社会运行机制交织形成的过渡性现象。以去行政化为核心的居委会减负改革与居委会过度行政化、居委会负荷未有效缓解并存的现实表明,深入分析居委会改革对策,需要更具包容性的理论框架和分析路径。居委会负荷过重现象的生成机制为:在不完全法理契约下,社区居委会责任无限、权力有限,责权结构性失衡;在不完全行政契约下,社区居委会权力模糊、依附性强,制度化建设薄弱;在不完全自治契约下,社区居委会利益表达、利益协调能力弱,利益满足机制匮乏。去行政化仅是居委会减负机制的选择性途径,实际上,居委会的治理效能受社区治理结构的复合性与多元性影响,因此,社区居委会改革的关键并不在于简单片面地去行政化,而在于治理结构适应性调整与治理资源有效整合,进而增进其在社区治理绩效中的贡献率。
High load operation of neighborhood committee is a transitional phenomenon formed by interweaving of grassroots governance logic,grass-roots government administrative system practice and social operation mechanism.By introducing the incomplete contract theory,formation mechanism of high pressure can be summarized as follows,under the incomplete legal contract,neighborhood committee has unlimited responsibility,limited power and structural imbalance of responsibility and power;under the incomplete administrative contract,neighborhood committee has vague rights,strong dependence,and weak institutional construction;under the incomplete autonomous contract,neighborhood committee has weak interest expression and coordination ability,and lacks interest satisfaction mechanism.Therefore,deadministration is only a selective way to reduce the burden of the neighborhood committee.In fact,governance efficiency of neighborhood committee is affected by the complexity and diversity of community governance structure.Therefore,the logical conclusion is that reform of neighborhood committee cannot besimply located on deadministration,the key to the reform of neighborhood committee rest on enhancing its contribution rate in the performance of community governance through adaptive adjustment of governance structure and integration of governance resources.
