摘要
宅基地改革是农村土地制度改革、实现乡村振兴的关键一步,宅基地管理制度的完善是实现宅基地“三权分置”改革的基石.当前宅基地管理制度中存在公权与私权管理相混淆,政府行政管理过度扩张,农民集体自主管理不断弱化等问题.因此,必须在理顺政府与农民集体宅基地管理关系的基础上,限制行政管理权的扩张,落实农民集体享有的自主管理权,发挥农民集体自主管理的积极性和主动性,为宅基地制度的进一步探索奠定基础.
Homestead reform is a key step in the reform of rural land system and the realization of rural revitalization,and the improvement of homestead management system is the cornerstone of the “Three Rights Division”reform of homestead.In the current homestead management system,there are problems such as the confusion between public rights and private rights management,excessive expansion of government administration,and the continuous weakening of farmers' collective independent management.Therefore,it is necessary to limit the expansion of administrative power,implement the autonomous management rights enjoyed by the farmers' collectives,and give play to the enthusiasm and initiative of the farmers' collective autonomous management on the basis of rationalizing the relationship between the government and the farmers' collective homestead management to lay the foundation for further exploration.
