摘要
美国学生参与大学治理的四条路径是:学生→大学治理机构;学生→学生代表→大学治理机构;学生→学生会→大学治理机构;学生→学生会→学生代表→大学治理机构。其关键环节是学生代表在学校的有关决策会议上以提议、讨论甚至表决的形式参与大学治理。美国学生参与大学决策的合法性目前尚存在争议,参与过程中程序正义与实质正义价值间存在潜在冲突。基于协同治理理念而诞生的美国学生参与大学治理的制度安排对完善中国的现代大学制度具有重要的启发意义:畅通学生参与大学治理的途径;构建学生和大学治理机构之间的协同治理机制;培养学生精英的同时培育广大学生的民主参与意识和能力。
American students'participation in university governance is mainly realized through four paths,which are student→university governance,student→student representative→university governance,student→student union→university governance,and student→student union→student representative→university governance.The key step is that student representatives participate in university governance by proposing,discussing and voting at relevant decision-making meetings.The legitimacy of American students'participation in university decision-making is still controversial.The potential conflict between procedural justice and substantive justice in the process of their participation is also a problem that cannot be ignored.In addition,the institutional arrangement of American students participating in university governance based on the concept of collaborative governance has important implications for the improvement of China's modern university system:unblocking the channels for students to participate in university governance;building a collaborative governance mechanism between students and university governance institutions;developing the awareness and ability of democratic participation of the majority of students while cultivating student elites.
