摘要
制销假、劣药的行为涉嫌生产、销售假药、劣药罪;护工收售药品包装用于制销假、劣药的行为,可成为上述罪名的正犯或共犯。为维护我国正常药品监管秩序,应从源头上全方位、全过程进行监管;关于规范护工收受药品包装的行为,应从立法、司法和执法等方面作相应规则的重塑。
The behavior of making and selling fake and inferior drugs is suspected to be guilty of producing and selling fake and inferior drugs,and the nurses'behavior of accepting and selling drug packaging for making and sell⁃ing fake and inferior drugs can be convicted as the principal or accomplice of the above charges.In order to maintain the normal drug regulatory order in China,we should supervise the whole process from the source;and regulations should be reshaped from the legislative,judicial and law enforcement to regulate thenurses'behavior of accepting drug packaging.
