摘要
借助logistic回归模型分析2010-2019年有扶养义务的人遗弃致人死亡的判决,可以发现不作为故意杀人罪认定的影响因素与判断逻辑。通过卡方检验可知,在仅考虑单一因素的情况下,遗弃对象、地点、天气情况、行为程度、遗弃次数及时长、主观方面、他人是否知悉或协调对定罪具有影响显著性。但是,二元logistic回归模型分析结果表明,在综合因素作用下,仅有遗弃地点偏僻或隐蔽、天气恶劣、明知会发生死亡结果对以故意杀人罪定罪具有显著性影响。分析故意杀人罪的裁判推理与理论的契合关系可知,71.43%的判决推理契合了排他支配设定说。从量刑的数据来看,即便是将有抚养义务的人遗弃致人死亡认定为故意杀人罪,相对于普通故意杀人罪而言,其量刑也是明显偏低的。综合定罪和量刑两方面的数据分析,我国司法实践对于将有抚养义务的人遗弃致人死亡认定为故意杀人罪既不存在过度泛化的问题,也不存在量刑过重的问题。
Based on the reflection on the formal theory of duty to act,many scholars in academic circle have begun to advocate the substantial theory of duty to act,in order to limit the scope of ingenuine omission crime.Relevant judicial interpretations also tend to adopt the substantial theory of duty to act.However,it is still inexplicable to see which theory has been adopted in judicial practice.By analyzing the verdicts of abandonment of a person with dependent obligations in 2010-2019,we can find that the factors and judgment logic of intentional homicide by omission.It can be seen through the Chi-square test,in the case of only a single factor,the object of abandonment,location,weather conditions,degree of conduct,the number and length of abandonment,subjective aspects,whether or not others know or coordinate has a significant impact on the conviction.However,the results of the dual logistic regression model analysis show that under the influence of comprehensive factors,only the abandoned place is remote or hidden,bad weather,knowing that death will occur has a significant impact on the conviction of intentional homicide.The relationship between the judicial reasoning and the theory of intentional homicide can be seen,and 71.43 percent of the judgment reasoning is consistent with the exclusive domination setting.According to the sentencing data,even if the person who has the obligation abandoned the death result is considered to be intentional homicide,the sentence is significantly lower than that of ordinary intentional homicide.Combining conviction with sentencing data analysis,it can be said that in judicial practice,intentional homicide by omission has not been unjustifiably expanded,nor has excessive sentencing been imposed.It can be seen that judicial practice has maintained a very cautious attitude towards the determination of intentional homicide by omission.
