摘要
马克思产权思想和西方产权理论实际上都蕴含两个基本内容或逻辑主线:一是经济与法律的关系,二是效率与公平的关系。基于两者的比较分析,对我国农村产权改革的深化进行思考,有两点基本认识:第一,产权立法要顺应客观经济规律,在此基础上充分发挥上层建筑的能动作用;第二,从经济内容来看,完整、有效的农村产权改革不仅涉及产权法律的修订,而且必须进行相关经济机制的构建。沿着产权理论中的经济—法律、效率—公平这两条逻辑主线,我国农村产权改革的深化在继续坚持农村集体所有制和基本经营制度不变前提下还应坚持两个基本原则:公平与效率兼顾、政府与市场结合。在我国深化农村产权改革中,马克思的产权思想应当在改革方向、原则上发挥根本性指导作用,同时应有分析、有选择地吸收、借鉴西方产权理论中的有益成分,紧密联系当前我国工业化和城镇化进程中农业现代化的新情况,坚持问题导向的研究,推进中国特色社会主义政治经济学产权理论的创新和发展。
Actually both Marx s thought of property rights and western theories of property rights contain two basic contents or main logical lines:one is the relationship between economy and law,and the other is the relationship between efficiency and fairness.Based on the comparative analysis of the two theories,there are two basic understandings in reflecting on the deepening of the rural property rights reform in China:first,the property rights legislation should conform to the objective economic law,on this basis,the active role of superstructure should be given full play to;second,from the perspective of economic content,a complete and effective rural property rights reform involves not only the revision of property rights law,but also the construction of relevant economic mechanisms.Following the two main logical lines of economy-law and efficiency-fairness in property rights decision,on the premise that the rural collective ownership and basic management system remain unchanged,China s rural property rights reform should adhere to two basic principles:balancing between fairness and efficiency,and combining the advantages of government and market.In deepening the reform of rural property rights in China,Marx s thought of property rights should play a fundamental guiding role in the direction and principle of the reform.At the same time,we should analyze and selectively absorb the beneficial elements of western property rights theories,closely link with the new situation of agricultural modernization in the process of China s industrialization and urbanization,adhere to the problem-oriented research,and promote the innovation and development of the property rights theory of socialist political economy with Chinese characteristics.
