摘要
优化营商环境是指改善企业在市场准入、生产经营等环节的制度环境,以降低企业的制度性交易成本。充分有效地保护知识产权是优化营商环境的重要方面。为了更好地发挥政府在改善知识产权保护制度环境中的基础性作用,保障权利人以更低的费用、更短的时间、更有效的方式保护其知识产权,需要充分发挥政府在知识产权保护中的制度供给职能、公共服务职能、市场监管职能和纠纷解决职能。法治政府的建设,尤其是职能与权限的法定化、知识产权行政体制机制的优化以及对职能履行的事中和事后监督,为政府依法全面履行上述职能提供了全方位保障。
Optimizing business environment is to improve the institutional environment for enterprises in terms of market access,and production and operation,to reduce the institutional transaction cost of enterprises.Fully and effectively protect intellectual property rights is an important aspect of optimizing business environment.To bring full play the government's basic role in improving IP protection institutional environment,and guarantee the IPRs of right holders to be protected with less cost and time,and in more effective way,it is necessary to give full play to the functions of government in institutional supply,public service,market supervision and disputes settlement.The construction of the government under the rule of law,especially the legalization of its functions and authority,the optimization of the administrative system and mechanism of intellectual property rights,and the supervision of the performance of functions in and after the event,provides a comprehensive guarantee for the government to fully perform the above functions according to law.
