摘要
近年来,自杀事件层出不穷。公开进行的自杀行为和其他扰乱公共秩序行为在一定程度上会造成社会公共秩序混乱。自杀事件的突然性和发展的不确定性需要公安机关采取一定规制手段,但基层警务工作在具体操作层面、执法环境层面和法律制度层面都存在困境。自杀事件中扰乱公共秩序行为具有主体的复杂性、行为的突发性、影响的社会性三大基本特点。公安机关需要在处置自杀事件时遵循一定原则,建立起从事前预防、事中干预到事后处置的规制路径,从而在制度体系建设、工作机制完善、支持网络构建等方面为处置自杀事件、查处扰乱公共秩序行为提供保障和支持。公安机关应按照以公安机关为核心、以社会治理为方向、以警务规制为根本的基本思路,适当拓展警务工作内容,切实提升警务工作的效果。
In recent years,suicides have emerged in an endless stream.Public suicidal behaviors and other acts that disturb public order will cause social public order confusion to a certain extent.Because of the sudden and uncertain characteristics in suicide,public security organs need to adopt certain regulatory measures.However,grassroots policing work have difficulties at specific operational levels,the law enforcement environment levels and the legal system levels.The behavior of disturbing public order in suicides has three basic characteristics:the complexity of the subject,the suddenness of behavior,and the sociality of influence.When dealing with suicides,public security organs need to follow certain principles and establish a regulatory path for pre-disintegration,inter-institutional intervention and post-disposal.In this way,it can provide guarantee and support for handling suicides and investigating and disrupting public order from the aspects of system construction,perfect working mechanism and support network construction.Public security organs should follow the basic ideas of taking public security organs as the core,taking social governance as the direction,and using police regulation as the fundamental,appropriately expanding the contents of police work and effectively improving the effectiveness of police work.
