摘要
以快速崛起的移动医疗平台的发展现状为切入点,在分析国内外相关监管策略的基础上,系统性地对其迅猛发展背后隐藏的诸如医疗服务提供者资质真实性审查困难、质量监管不到位、用户隐私存在泄露风险、平台为求商业利益过度宣传误导用户、问诊过程缺乏医学人文关怀等主要伦理问题进行了重点研究。解决这些问题需从以下两个层面着手:政府层面,要加大监管力度并积极推进相关领域的法制建设,实现监有规、管有法;平台自身层面,要加强自查自纠并从技术层面完善对患者隐私的保护,树牢生命伦理意识,提升医学人文关怀。
The paper embarks on the rising development of mobile health,deeply analyzes relevant regulatory strategies at home and abroad.The research focuses on the hidden problems behind the rapid development,such as the difficulty to check the qualification of medical service providers,the absence of quality supervision,the risk of user privacy disclosure,users being misled due to excessive propaganda in pursuit of commercial interests,and the lack of humanistic care in medical consultation.Suggestions are provided on two levels.One is government perspective:to tighten up the legal system.The other is mobile health perspective:to strengthen self-regulation,and improve the protection of patients’ privacy technically,to heighten the consciousness of bioethics,and finally achieve the purpose of improving medical humanistic care.
