摘要
地方人大立法规划中有不少需要研究的问题。地方党委对同级人大立法规划的领导,与党中央对全国人大立法规划的领导,应当有所不同,建议充实地方党委的立法专业力量,加强和改善对同级人大立法规划的领导。编制地方立法规划时,应当体现立法中的探索创新精神,能用规章、政策解决问题的,尽量不制定法规,重视立法监督在规划计划中的地位,激活地方立法的有效期,适当改变对法的普遍性和稳定性的传统认识。在省级以下的地方立法中,应当逐级淡化立法规划,注重通过年度计划的方式灵活安排立法项目。在编制立法规划时应当多发挥人大常委会工作机构的作用,以克服部门利益倾向、解决立法门槛问题,并为代表委员提出议案直接进入立法程序留出通道。地方人大还可以多采用决议、决定的方式来解决立法问题,为立法规划留下空间。
There are many problems that need to be studied in the legislative planning of local people's congress.It is not appropriate to equate the legislative planning of local people's congress with that of the National People's Congress.When preparing local legislative planning,legislators should embody the spirit of exploration and innovation in legislation.If problems can be solved with existing regulations and policies,enacting new laws and regulations appears unnecessary.Legislators should attach importance to the legislative supervision in the planning phase,activate the validity period of local legislation,and carefully adjust the traditional understanding of the stability of the law.In local legislations below provincial level,legislative planning should be minimized and executing of legislative plans be valued.Legislative projects should be flexibly arranged through annual plans.In preparing legislative planning,the role of the working body of the Standing Committee of the local people's congress should be enhanced in order to overcome the tendency towards protectionism of administrative departmental interests.Local people's congresses can also use resolutions and decisions to solve legislative problems,leaving room for legislative planning。
