摘要
无人机低空公共航路的提出,打破了载人航空时代空域权与地面既有权利二者之间的权利缓冲层(目视飞行最低高度),使二者权利范围冲突更为激烈。这种权利冲突依照传统的物权法观点表现为空域权对空间权的限缩。目前我国相关法规的研究对这种冲突矛盾的关注度不足,对空域的本质、空域所有权主体等问题的探讨亦不够充分。文章首先对空域与领空、空气之间的差异性进行论证,进而在批判美国就这一权利冲突所采取的应对措施缺陷性的同时,吸收其财产法学的新兴理论即财产权二元论,为调和空域权与空间权之间的冲突提出以下调和路径:一是立法中对空域概念予以明确;二是从法律层面上确认空域所有权主体;三是低空权利冲突中运用物权二元论。
The proposal of UAV's low altitude public air routed makes the airspace righted and the ground's existing right broke the right buffer layer(the minimum height of visual flight)between the two in the era of manned aviation,presenting a more intense conflict situation of right scope of space.According to the traditional view of property law,this kind of right conflict will manifesting as the limitation of airspace right to space right.At present,the research of relevant laws and regulations in our country has not paid enough attention to this conflict and contradiction,nor to the nature of airspace,the subject of airspace ownership and other issues.So first of all,this paper demonstrates the differences between airspace,airspace and air,and then criticizes the defects of the response measures taken by the United States on this conflict of rights,while absorbing the emerging theory of property law,namely the dualism of property rights,to put forward the following solutions to reconcile the conflict between airspace rights and space rights,first the concept of airspace should clarified in legislation,second from the legal level,the third is to use the dualism of real right in the conflict of low altitude rights.
