摘要
推进河湖保护与修复治理、维持河湖健康生态,是新时代水利发展改革的核心内容。《河北省河湖保护和治理条例》是河北省第一部全面系统对河湖保护和治理予以规范的省级地方性法规,体现了“水利工程补短板,水利行业强监管”的要求,在规划编制、保护名录、采砂管理、河湖生态补水、公益诉讼、区域协同、涉河文化保护、河(湖)长制等方面突出了制度创新。遵循水事立法新思路,以《条例》为例,系统地探讨河湖保护与修复治理的重点和方向,提出合理的法律依据和治理措施,为河湖治理相关单位准确地运用与河湖保护治理相关的法律条款提供思路。
Promoting the protection and rehabilitation of rivers and lakes and maintaining the healthy ecology of rivers and lakes are important opportunities and core content of water resources development and reform in the new era.The Regulations on the Protection and Treatment of Rivers and Lakes in Hebei Province are the first provincial-level local regulations that systematically and comprehensively regulate the protection and manage⁃ment of rivers and lakes in Hebei Province.It embodies the requirements of“water conservancy project rein⁃forcement board,strong supervision of water conservancy industry”,and highlights system innovation in plan⁃ning,protection directory,sand mining management,river lake ecological water supply,public interest litiga⁃tion,regional coordination,river related cultural protection,river(Lake)director system,etc.Following the new thinking of water legislation,taking the regulation as an example,this paper systematically discusses the fo⁃cus and direction of river and lake protection and restoration and governance,puts forward reasonable legal ba⁃sis and governance measures,and provides ideas for the relevant units of river and lake governance to accurate⁃ly use the legal provisions related to river and lake protection and governance.
