摘要
为规范大中型水利水电工程建设征地和移民安置补偿工作,2006年国务院颁布第471号令《大中型水利水电工程建设征地补偿和移民安置条例》,明确水电工程开发遵循"政府领导、分级负责、县为基础、项目法人参与"的管理体制,但在移民安置实施阶段当前的移民管理体制仍暴露出较多的问题。为此,重点从我国移民安置管理体制发展、移民安置工作对管理体制的需求、当前移民管理体制三方面进行分析,并结合国家相关政策法规,提出完善大中型水电工程移民管理体制的建议。
In order to regulate the land acquisition and resettlement compensation for large and medium-sized water conservancy and hydropower projects,the State Council promulgates“Regulations on Land Acquisition Compensation and Resettlement for Large and Medium Water Conservancy and Hydropower Projects”in 2006.The Regulations clarifies that the hydropower development follows the management system of“Government-led,hierarchical responsibility,county-based,project corporation participation”,but the resettlement management system still exposes many problems during the resettlement implementation phase.To this end,the development of resettlement management system in China,the needs of resettlement work on management system and the current resettlement management system are emphatically analyzed,and combined with relevant national policies and regulations,the suggestions to improve the management system of large and medium-sized hydropower project resettlement are put forward.
