The Cultural Logic of Law-related Education in Contemporary China

摘要 从我国法治发展的历程与实践看,法治文化是法治建设与法治现代化的根本。法治教育作为构建现代法治文化的基本路径,其内含着文化发展过程"冲突-传播-认同-自觉"的基本逻辑。通过研究可以看到,近代以来的法律文化冲突是法治教育的逻辑起点,法治文化传播是法治教育的实践方式,法治文化认同是法治教育的内在要求,而法治文化自觉是法治教育的初心使命。 Judging from the development and practice of the rule of law in China,the culture of rule of law is the foundation of the construction and modernization of the rule of law.The law-related education,as a basic path of constructing a modern culture of rule of law,contains the basic logic of the"conflict-communication-identification-consciousness"of the cultural development process.It can be seen from the research that the conflict of legal culture is the logical starting point of law-related education,the transmission of legal culture is the practice of law-related education,the identification of legal culture is the inherent requirement of law-related education,and the culture of legal culture is the original mission of law-related education.
