摘要
石家庄市作为京津冀一体化区域中的"示范"城市,生活垃圾分类状况不容乐观,具体表现为"三重困境"——理念淡薄、执法"怠慢"以及专门立法"缺位"。立足于石家庄市垃圾分类的现实困境,以"环境宪法"、环保性法律规范以及地方性法律规范为治理依据,探索石家庄市生活垃圾分类主体、标准或标志、激励、收费以及监督与保障等法律制度的建构。
As a"demonstration"city in the Beijing-Tianjin-Hebei integration region,Shijiazhuang City is not optimistic about the status of domestic waste classification,which is manifested by the"triple predicament":weak concept,slack in law enforcement,and absence of special legislation.Based on the practical difficulties of Shijiazhuang City's garbage classification,and taking the environmental constitution,environmental protection legal norms and local legal norms as the basis of governance,this paper explored the construction of Shijiazhuang City's domestic garbage classification subject,standards or signs,incentives,fees,supervision and security and other legal systems.
