摘要
中国时尚产业的发展需要有新型的知识产权保护机制 中国时尚产业知识产权处于发展中 存在审核期过长、产权判断模糊、信息化的挑战及维权困难等问题 文章比较研究世界五大时尚之都知识产权保护 在发挥知识产权激励作用、开辟专项快速审查通道和建立多重产权保护机制等方面的发展经验 从内部制度体系和外部实施环境两个角度入手 借鉴吸收并提出建立快速审查制度、明确版权主体客体、丰富时尚产权体系、提高产权保护意识、加大执法力度、加强商业成果转化等方面的建设性意见 为实现 2020 年建设创新型国家的战略目标保驾护航.
The development of China’s fashion industry needs a new intellectual property protection mechanism.Since the intellectual property of China’s fashion industry is still in the development process,there are still some problems,such as too long audit period,vague judgment of property rights,the challenge of information technology and the difficulties in safe guarding rights.This paper carries out a comparative study on the development experience of global top 5 fashion cities in intellectual property protection from the following aspects:giving play to the incentive function of intellectual property rights,opening up special rapid audit channels and establishing multiple property rights protection mechanisms,etc.Then,starting from internal system and external implementation environment,it puts forward constructive suggestions on establishing a rapid audit system,clarifying the subject and object of copyright,enriching the system of fashion property rights,enhancing the awareness of property rights protection,intensifying law enforcement,and strengthening the transformation of commercial achievements,so as to ensure the realization of the strategic goal of building an innovative country by 2020.
