摘要
比特币等数字货币的火爆使区块链技术进入大众视野,各领域纷纷展开对其应用的探索和研究。金融领域对区块链技术涉及较早,应用更为多元。区块链技术的应用,在促进金融创新发展的同时,也给金融监管带来多重挑战。在区块链技术下,金融监管面临监管理念滞后、监管无力和监管留白的困境。面对区块链新技术,一方面,金融监管需要转变监管理念,重构监管逻辑,实现从纯监管到监管治理一体化,由体外被动监管转为内嵌式主动监督;另一方面,需要借鉴国外“沙箱监管”经验,并对金融机构、金融产品、服务渠道在内的监管制度进行全面更新。
The popularity of bitcoin and other digital currencies has brought block chain technology into the public’vision and the exploration and research on its application have been carried out in various fields.The field of finance has been involved in the block chain technology earlier and has more diversified applications.The application of blockchain technology,while promoting the development of financial innovation,brings multiple challenges to the financial regulatory.Under the blockchain technology,the financial supervision is facing the dilemma of lagging supervision concepts,weak supervision and blank supervision.Facing the new technology of blockchain,on the one hand,the financial supervision needs to change the supervision concept and reconstruct the supervision logic to realize the integration supervision out of pure supervision and embedded active supervision out of external passive supervision;on the other hand,it needs to learn from foreign experience of“sandbox supervision”and comprehensively update the supervision regulations including financial institutions,financial products and service channels.
