摘要
文章用可靠的数据说明校园目前已经成为性侵儿童违法犯罪的高发场所。结合中国近年来法律的修改和完善,以及《未成年人保护法(修订草案)》中增加的预防校园性侵害等内容,提出学校应该普遍建立性侵害预防机制以及完善违法犯罪查询制度的建议。在讨论学校建立性侵害预防机制的必要性及基本原则基础上,提出预防机制的基本框架,即以儿童最大利益原则为核心,以校内预防工作制度建设、教职员工入职筛查、全员教育培训为机制主要内容,以第三方的评估对机制运行效果进行测评,以行政、经济、司法等手段为机制落实的保障措施,通过源头治理,达到降低校园性侵害违法犯罪发案率的目的。
Campuses have now become hot spots of sexual assault against children in China during recent years.The country has made greater efforts to revise and improve its laws and include the prevention of on-campus sexual assault into proposed amendments to the Law on the Protection of Minors.The article thus proposed to establish a preventive mechanism of sexual assault and improve the record system of criminal behaviors.Drawing on the discussion of the necessity of and basic principles of the establishment of preventive mechanism of sexual assault in schools,it put forward a framework of the preventive mechanism,which gives priority to the protection of the rights and interests of children,strengthens institutional building of on-campus preventive measures,conducts assessment of new education workers,and offer all faculty members relevant training.In addition,it will invite independent parties to make an evaluation of the operation of relevant mechanisms,employ administrative,economic and judicial tools,in a drive to resolve the occurrence of on-campus sexual assault from the root and curb relevant crimes.
