摘要
受英美法系、大陆法系、中华法系等因素的影响,近代我国行政违法案件审判法治转型中,行政司法派与民事司法派提出了不同主张。前者吸取大陆法系、中华法系中的某些因素,以“国权”为取向力主专设行政审判机关来提升制度的执行力。后者取法英美法系,以“民权”为取向呼吁由民事法院审理行政违法案件来确保法律平等。在民族主义高涨的历史条件下,行政司法成为主流路径选择,民事司法路径在短暂的实践后被放弃。在新时代行政法治化进程中如何维护国家权威与确保人民权利,这些思想主张依然不乏参考价值。
Influenced by the common law system,the civil law system and the Chinese law system,the administrative judicial school and the civil judicial school put forward different opinions in the transformation of the rule of lawin modern China.The former drewon some factors in the civil law system and the Chinese law system,and took"state power doctrine"as the purport to advocate the establish ment of a single administrative judicial organ to improve the execution of the system.The latter took the common law system and a"civil rights doctrine"as its purport,calling for the civil court to hear administrative cases and ensure the equality of law.In the historical condi tion of the upsurge of nationalism,administrative justicc had become the mainstream path choice and civil ludcial path had been aban doned after a short period of practice.In the process of administrative litigation legalization,these ideas still have some reference value how to realize the dual demands of safeguarding the authority of the state and ensuring the rights of the people in the new era.
