摘要
黑恶势力是经济社会健康发展的毒瘤,是人民群众深恶痛绝的顽疾,必须坚决依法予以打击,要以“零容忍”的态度,对黑恶势力违法犯罪重拳出击,不断增强人民的获得感、幸福感、安全感。目前全国扫黑除恶专项行动正如火如荼进行中,2018年以清除黑社会性质组织和恶势力、恶势力集团为主要目标,2019年以打击充当黑恶势力“保护伞”的公职人员为主要目标,各地都取得了良好的效果。在把握事实关、证据关、程序关和法律适用关的基础上,严禁刑讯逼供,防止冤假错案,结合历史经验教训,既要追求打击效果,也要保证案件质量,做到审慎定罪、审慎推定、审慎并罚,确保把每一起案件都办成铁案。
The evil forces are a tumor and stubborn disease of the healthy development of the economy in the society.They must be resolutely cracked down in accordance with the law.They must fight against the crimes of the evil forces with a“zero tolerance”attitude,and continuously enhance the people’s sense of gaining,happiness and security.At present,the nationwide special campaign to combat crime and evil is in full swing.In 2018,the main goal is to eliminate underworld organizations,evil forces and the groups.In 2019,the main goal is to crack down on public officials who serve as“protection umbrellas”for evil forces.All achieved good results.On the basis of grasping the facts,evidence,procedures,and laws,it is strictly forbidden to torture to extort confessions,to prevent unjust and false cases,and to combine historical experience and lessons,we must not only pursue the effects of crackdown,but also ensure the quality of the cases,and achieve prudenting conviction,presumption and prudence and punishment ensure that each case is turned into an iron case.
