无固定期限劳动合同制度“连续”内涵的争议与完善——以法院判决为切入点

摘要 《劳动合同法》制定时,鉴于劳动合同短期化严重,我国在《劳动法》的基础上,对无固定期限劳动合同制度进行了强化。但《劳动合同法》实施以来,出现了各种对无固定期限劳动合同制度中"连续"的规避和争议,且法院判决亦缺少统一观点,使无固定期限合同未能充分起到保护劳动者权益的作用。为解决此类问题,有必要在立法中明确"连续"的内涵、完善劳务派遣用工制度法律的规定、适当放宽无固定期限劳动合同的解除限制,进而完善我国无固定期限劳动合同法律规范体系。 When the Labor Contract Law was formulated, the short-term labor contract was universal. On the basis of the Labor Law, China further strengthened the non-fixed-term labor contract system. However, since the implementation of the Labor Contract Law, various circumventions and disputes have been made on the "continuity" of the unfixed-term labor contract system and the courts’ verdicts also lack a unified view, so that the contract without fixed term has not fully protected the rights and interests of laborers. In order to solve such problems, it is necessary to clarify the connotation of "continuity" in the legislation,improve the legal provisions of labor dispatching and employment system, moderately relax the restrictions on the termination of non-fixed-term contracts, so as to improve the legal norm system for labor contracts without fixed term in China.
