摘要
受气候变化的影响,北极冰融速度加快,北方航道上的船舶通行量持续增长,航道进入了高速发展阶段。但与此同时船舶事故溢油污染、船舶燃油污染以及海洋油气开发污染的发生风险也随之加大,北方航道水域的生态环境问题日益严峻。法律是北方航道环境保护的重要保障,然而现阶段北方航道环保法律制度发挥作用有限,具体表现在北方航道环保法律依据不充分、俄罗斯国内立法与国际公约存在冲突以及北方航道环境保护中俄合作法律制度的缺位。基于此,建议以IMO框架为基础制定和修改北方航道环保法律,协调俄罗斯国内法与国际公约间的冲突,并构建北方航道中俄环保合作法律制度,以促进北方航道的长足发展。
Affected by climate change,the Arctic ice melting rate is accelerating,the ship traffic volume on the Northern Sea Route continues to grow,and the channel enters a high-speed development stage.But at the same time,the risk of the ship accident oil spill,ship fuel pollution and marine oil and gas development pollution has al so increased,and the ecological and environmental problems in the waters of the Northern Sea Route have become increasingly serious.The law is an important guarantee for the environmental protection of the Northern Sea Route.However,the current environmental protection legal system of the Northern Sea Route has a limited effect,which is manifested in the inadequate legal basis of environmental protection,the conflict between Russian domestic legislation and international conventions,and the absence of the Sino-Russian cooperation law system on environmental protec tion.Based on this,it is recommended to formulate and revise the environmental protection laws of the Northern Sea Route based on the IMO framework,coordinate the conflict between Russian domestic law and international conven tions,and construct a legal system for Sino-Russian environmental cooperation in the Northern Sea Route to promote the long-term development of the the Northern Sea Route.
