摘要
随着国内建筑工程企业不断走出国门,加快了海外投资步伐,已经在海外建筑工程市场取得了一定成绩。但是,随之而来的各类合同风险问题也逐渐凸显,由于不同国家的政策、经济、环境等因素都存在差异,对于国内建筑工程企业在海外工程项目当中进行合同风险管控的要求也各有不同,需要制定科学、有效的合同风险管理机制,明确海外工程项目可能面临的合同管理风险,提升自身合同风险的控制能力,增强建筑工程企业在海外建筑市场中的核心竞争能力。论文分析了海外建筑工程合同谈判及签订阶段合同条款、合同管理过程和分包合同几个方面的合同管理风险内容。
With the domestic construction enterprises going abroad and accelerating the pace of overseas investment,they have made some achievements in the overseas construction market.However,various kinds of contract risk problems are gradually highlighted.Due to the differences in policies,economy,environment and other factors in different countries,the requirements for domestic construction enterprises to carry out contract risk management and control in overseas projects are also different.It is necessary to establish a scientific and effective contract risk management mechanism,clarify the possible contract management risks faced by overseas projects,improve the control ability of their own contract risks,and enhance the core competitiveness of construction enterprises in the overseas construction market.This paper analyzes the risk content of contract management in the negotiation and signing stage of overseas construction contract,contract management process and subcontract.
